It's not the first time a artist has drawn a character that Marvel doesn't own like back in 2015 when Marvel tried a Illuminati comic for the cover of issue 3 the Human Fly was drawn but legally Marvel was made to change it and Shocker took the place on the cover

The real reason why Hickman left the X-Men books was because his editors kept saying no to him wanting to use the "iconic" character Major X. And that's how I believe that's how it happened
